Cannabis Warning Labels for Pregnant and Breastfeeding Women

Healthcare regulatory policies have a significant impact on the health outcomes of

individuals, families, and communities. Both state and national healthcare legislation functions to

improve quality health outcomes and guide the nursing profession to care for patients.

Legislation is driven by influential organizations, such as major healthcare accreditors and

professional groups that support change in public policy. This is an analysis of a public health

concern affecting our most vulnerable population and a recommendation for policy change that

uses both a top-down and bottom-up approach to advocate for change.

A1. Public Policy Issue

On January 1, 2020, the state of Illinois legalized the adult use of marijuana with the

Cannabis Regulation and Tax Act of 2019. Illinois is the 11th state to pass law legalizing

cannabis for adult use, and the first state to pass such a law by legislation rather than a public

referendum. According to a report by Manzo, Manzo, and Bruno (2018), legalization of

recreational marijuana will boost the Illinois economy, create new jobs, and allow the state to

invest in critical infrastructure, schools, and drug treatment and prevention programs. The report

further states that the benefits of adult cannabis legalization outweigh the social costs (Manzo,

Manzo, & Bruno, 2018).With adult use marijuana in the nascent period of implementation in

Illinois, the social costs or consequences are yet to be fully realized. With legalization comes a

shift in the social acceptability of cannabis use and a growing perception of it being safe and

natural, even for use during pregnancy and breastfeeding.

In a study of marijuana dispensaries, Dickson et al. (2018) found that 69 percent of

dispensaries recommended marijuana products to treat first trimester nausea and only 31.8%

recommended speaking with a physician without being prompted. According to a research study

conducted by Koet al. (2018), 79% of 785 pregnant women who admitted use of marijuana in the

past year, perceived little or no risk of harm with prenatal use. Legalization of cannabis and

misconceptions associated with the safety of use during pregnancy has led to an increased

perception that marijuana is safe (Bayrampour et al., 2019). There is a need for clear

communication about the risks associated with prenatal marijuana use. This is a proposal for a

billto amend the Cannabis Regulation and Tax Actof 2005to update dispensary signage and

warning labels on all cannabis products to read: “WARNING: Use by pregnant or breastfeeding

women, or by women planning to become pregnant, may result in fetal injury, preterm birth, low

birth weight, or developmental problems for the child” surrounded by a continuous heavy line.

This proposed amendment is designed to increase transparency and awareness of the dangers

associated with cannabis use while pregnant. Current law requires signage and warning labels to

include “should not be used by pregnant or breastfeeding women (Cannabis Regulation and Tax

Act of 2019).”An amended warning is critical in promoting greater public awareness of the risks

cannabis poses to unborn fetuses and breastfeeding babies.

Since the legalization of adult use marijuana in Illinois, there has been an increase in the

number of people who use cannabis products daily, including more pregnant women. In caring

for pregnant and postpartum patients, there has been an increase in the number of patients that

test positive for marijuana and openly express their perception on the safety of marijuana use

during pregnancy. A factor that is affecting an expectant mother’s choice to use cannabis

products is the lack of consistent information and messaging on the safety and effects of using

marijuana while pregnant. It is imperative that Illinois promotes an uniformed front that women
