In the criminal justice system, a trial can be defined as the examination in court of
the circumstances of fact and relevant law in a case for the intention of convicting or
acquitting the defendant (Schmalleger, 2019). A trial is an opportunity for the
government to argue a case (Criminal Trial Overview, 2019). It is also the chance that
the defendant to discredit any evidence that the government may have and offer its own
in some cases. Once both parties have presented their arguments, the jury meets, as a
collective group, to consider whether the defendant is guilty or not guilty of the crime
they are being charged for.
From the moment a defendant is arrested until the moment the sentence is
given, the criminal trial process is meticulously orchestrated (Schmalleger, 2019). This
process begins with the trial initiation. The United States Constitution holds a speedy
trial provision in the Sixth Amendment, that guarantees that in all criminal prosecutions,
the accused have a right to a speedy and public trial. The U.S. Congress passed the
Speedy Trial Act in 1974, which grants the dismissal of federal criminal charges in
cases that the prosecution does not seek an indictment or information within 30 days of
arrest or where a trial does not begin within 70 working days after indictment for any
defendants who pleaded “not guilty.”
The Sixth Amendment also grants the right to an impartial jury (Schmalleger,
2019). This second step gives the prosecution and the defense counsel the right to ask
potential jurors questions, also known as voir dire examination. Potential jurors may be
excused for several reasons like already having a formed opinion of the case or being
racist. Both the prosecution and the defense counsel can use challenges to ensure that
