Introduction
In the United States, the federal government and mostly of the state government
have created antitrust laws and policies. These have been created to promote a competitive and
free marketplace environment, guarding citizens and companies from the effects of monopoly
power. Many cases have been reported to the U.S Department of Justice Antitrust Division and
have been tried for not following the laws and regulations. In this paper, the focus will be the
case of the United States versus Heritage Pharmaceuticals, Inc.
Summarized Charges and Rebuttal/Mitigation Charges
The purpose of antitrust laws is to develop public policy principles where customers are
protected against private economic power in a competitive marketplace. This generates at
atmosphere in which quality goods are well allocated and services are offered at the lowest price
possible. Federal antitrust laws are based on three main acts: Sherman Act, Clayton Act, and
Federal Trade Commission Act.
Sherman Act, more specifically Section 1, prohibits all conspiracies or agreements that
restrain any type of trades. This includes agreements or conspiracies to fix prices, divide market
territories, or group of customers, boycotts, or use of strategies with the knowledge and intent of
hurting the competition. This Act protects patients from low quality and high price services
cause by inefficient strategies from organizations. Most of the time, this act judges business
practices for actions that are justified from a business perspective but illegal in the eyes of the
