Environmental Laws Paper
, The Endangered Species Act of 1973 is a comprehensive document which
declares that congress finds the plants and animals described within “are of
esthetic, ecological, educational, historical, recreational, and scientific value to
the Nation and its people”, andis thorough in its coverage of endangered wildlife
and those charged with their protection. The Endangered species Act primarily
authorizes the United States Fish and Wildlife Service with maintaining a list of
endangered species worldwide. In conjunction with having to maintain a list of
endangered species the Endangered Species Act also forces federal agencies to
ensure their actions do not damage or affect any listed species. Finally, the
Endangered Species Act regulates trade and travel of these listed species heavily.
As the name implies the Endangered Species Act was established in 1973, it
was signed into law by President Richard Nixon on December 28 th, 1973. At first it
began as an outline on February 8, 1972 intending to be a stronger law to protect
endangered species of wildlife, with the ability of being charged as a federal
offense for the taking of endangered species and added protection to avoid their
extinction. The bill was presented by Senator Harrison A. Williams of the
Democratic party to the United States Senate on June 12, 1973, by the 24 thof June
it was unanimously voted into effect. The House followed shortly after with its
approved version on September 18, 1973 with a 390 aye and 12 nay vote. Shorty
after it was reported to the conference committee and was approved by both the
Senate and House.
The entities empowered by this legislation are, of course, the United States
Fish and Wildlife Service, but also include The United States National Oceanic and
Atmospheric Administration Fisheries Service, the state Game and Fish
department of each state, as well as any other federal entity that may come into
contact with any endangered species in any circumstance, which must later
report the incident to the United States Fish and Wildlife Service. With this power
provided to them, they are legally backed by the ability to punish anyone who
causes a threat to endangered animals with “[fines] not more than $ 50,000 or
imprisoned for not more than one year, or both”, not only that but civil penalties
can also include repercussion “of not more than $ 25,000 for each violation”
