Federal and state guideline require public schools to follow a code of conduct that

ensures that the school environment is a safe place for all students and staff to learn and work in

daily (Center for Parents Information and Resources, 2017). Staff and students, including

students with IEP’s must follow these codes of conduct and rules to maintain a safe environment

and students with IEP’s are not exempt from these following the rules but Individual with

Disabilities Act (IDEA) provides protection to student with IEP’s to ensure they are not

disciplined differently than their non-disabled peers, they are not punished for behaviors that is

caused by their disability and they do not miss a lot of time from the services stated in their IEP.

The following is a case study on a fifth-gradestudent that receives special education services

named Charlie

Suspension

Charlie has no history of misbehavior but recently was caught stealing from school and

threatened to physically harm his teacher. Charlie received a thirteen-day suspension.When a s

student has been suspended or removed from the school setting,he or she is being treated likeany

other students without disabilities and they also do not receive their services in his or her

IEP(Raj, 2018). When the suspension is longer than ten days it will be considered a change of

placement IDEAprovides protection for the student with disabilities rights (Raj, 2018). When

there is a change in placement due to a long suspension IDEAprovides protection for students

with right to an appropriate education and services (Raj, 2018).

Charlie has been given a thirteen-day suspension, once he has reached the eleventh day of

suspension the special education teacher must begin a manifestation determination with the rest

of Charlies IEP to look at whether Charlie disability caused or directly caused him to steal and
