Mnyongani argues that the 1996 Constitution was praised for its transformative
agenda, aiming to shift from the oppressive apartheid regime towards a more
inclusive and democratic society. Apartheid left South Africa with deep-rooted issues,
particularly among the black community. The 1996 Constitution, praised for its
inclusion of socio-economic rights and transformative agenda, was embraced by the
new government. However, it faced challenges in unifying the racially defined
homeland system into one country.

The Constitution aims to heal past divisions and establish a society based on
democratic values and human rights. It includes provisions promoting equality,
human rights, and social justice, and establishes a constitutional democracy with
checks and balances, including an independent judiciary and a Bill of Rights. The
objective of a transformative constitution is to rectify the inequitable political,
economic, and social conditions that marked our colonial and apartheid eras, and to
cultivate a society founded upon principles of democracy, human rights, and justice. 1

The South African Constitution is based on the principles of human dignity,
nonracialism, and non-sexism.2 The Constitution addresses race within the context
of equality, aiming for both formal and substantive equality. 3 Formal equality focuses
on the formal way the law treats each person/group. It denies the need to take into
account the social and economic context or the differences in power, status and
opportunities between individuals or groups when judging whether the equality
standard has been breached or not. Focuses on the actual economic, social and
political conditions of groups and individuals in society.
