Sociaal = bescherming van de economisch en sociaal zwakkeren in de samenleving
Bronnen van het sociaal recht
De nationale wetten, decreten en koninklijke en ministeriële besluiten
Specifiek is wel dat de wetgever inzake sociaal recht in ruime rekening houdt met de adviezen van de
sociale partners
Hiërarchie der rechtsbronnen in de sociale wetgeving
Deze hiërarchie houdt dus in dat een lagere rechtsbron niet tegenstrijdig mag zijn met een hogere
rechtsbron. Aldus geldt een rechtsbron van sociaal recht boven alle rechtsbronnen van sociaal recht
die lager zijn dan deze rechtsbron en geldt omgekeerd dat alle rechtsbronnen van sociaal recht die
hoger zijn dan deze rechtsbron voorrang hebben op deze rechtsbron als er een verschil is.

4. De collectieve arbeidsovereenkomsten bij koninklijk besluit niet bekrachtigd (niet algemeen
