CHILD ABUSE AND NEGLECT INTERVENTIONS - ANSWER--ASSESS FURTHER

1.) Standard of care requires that therapists assess for child abuse and neglect when any risk factors are
present.

-MANDATED TO REPORT:

1.) Physical abuse, sexual abuse and neglect.

*Emotional abuse is optional

*Exposure to domestic violence is optional report

2.) Abuse/neglect that occurred outside CA to

California state authorities.

3.) Consensual sex between minors is only a mandated report when 1) one of the

participants is 13 or younger and the other is 14 or older or 2) If one of the participants is 21 or older
and the other is under 16.

*Nonconsensual sex with a minor is always reported.

4.) Lewd and lascivious behavior between minors ages 14 or 15 with a partner who is

10 or more years older is a mandated report

5.) Downloading, possessing or transmitting child pornography constitutes sexual

exploitation of a minor and requires a mandated report.

-MAINTAIN CONFIDENTIALITY

1.) If the client is 18 or older and reports abuse occurred when s/he was a minor, unless there was
reasonable suspicion that the perpetrator was abusing other minors.

2.) A child taken out of state without permission would constitute kidnapping and not

abuse or neglect. The therapist should maintain confidentiality and encourage

client to contact law enforcement.

friends

-ABDUCTION:taking dependent adults or elders out of California or preventing them from

returning to California without their consent or against their will.

-SELF NEGLECT: dependent adult or an

elder can't adequately provide for his or her own needs due to physical or mental

limitations or substance abuse

* Emotional Abuse: (optional, not mandated, report) Treatment that harms or

endangers the emotional well-being of a dependent adult or an elder.

-REPORT TO

1.) call Adult Protective Services (APS) immediately, submit

written report within 2 working days

2.) If occurs in a long-term care facility, contact local law enforcement immediately,

written reports must be filed with law enforcement and local ombudsman.
