Sedition Law (Section 124a of IPC)

Present scenario:
- A three judge bench consisting of the sedition law directed that all pending trials,
appeals, proceeding on charges under sedition law to be kept in abeyance
( temporary suspension). Also requested states to not register any fresh cases
under it. No criminal law has ever been stalled before.

- Kedarnath vs State of Bihar case:
The 5 judge constitution bench upheld the validity of the the section However,
the court attempted to re-strict the scope for its misuse.

Unless accompanied by an incitement or call for violence, criticism of the
government cannot be labelled sedition.

The court issued guidelines, when criticism of govt. cannot be labelled sedition. It
said not all speech with "disa ection","hatred" or "contempt"against the state
but only speech that is likely to incite "public disorder" would qualify as sedition.
The phrase "public disorder" is not itself contained in Section 124a, the court
read into it.

The Kedar Nath guidelines put the onus on police to distinguish between
legitimate speech from seditious speech.



- Sedition law in other countries:
In the United Kingdom, the sedition law was repealed under Section 73 of the
Coroners and Justice Act, 2009, citing a chilling e ect on freedom of speech and
expression.

Australia repealed its sedition law in 2010, and Singapore did so last year.

In the United States, sedition is a federal felony under the Federal Criminal
Code,Section 2384.

- Pendency of sedition cases
399 cases since 2014

Karnataka, Assam, Jammu Kashmir, Uttar Pradesh, Nagaland

- Indo- Nepal border dispute:

controversy, followed by Lipulekh. Lipulekh is located in a far
west point near Kalapani, an area of territorial dispute between
India and Nepal. Both the countries claim these regions as part
of their territory. India claims Kalapani as part of Pithoragarh

Dharchula district.

deserti cation

Deserti cation is a type of land degradation in which a
relatively dry land region becomes increasingly arid, typically
losing its bodies of water as well as vegetation and wildlife.
- What is UNCCD?
Was founded in Paris.197 members, formed in 1994. India became a
part in 1996.
It is the Sole legally binding international agreement to address
deserti cation.



- What is COP15?
COP 15 took place from 9-20th May in Abidjan, Côte d’Ivoire,
West Africa. Theme was Land. Life. Legacy: from scarcity
to prosperity.
Drought, land restoration, and related aspects such as land
rights, gender equality and youth empowerment are among the
top considerations at COP15.

Cop14 was held by India in Greater Noida IN 2019. Theme
was restore land, safe future”

- The UNCCD envisions restoring one billion hectares of
degraded land by 2030, creating a land degradation-
neutral world.
