Legislation and codes of practice that relate to the storage and sharing of information in
health and social care. Legislation and codes of practice must be current and applicable
to England, wales or Northern Ireland and ensure you include the ones that apply to your
case studies from the following list:
Data Protection Act 1998
The Freedom of Information Act 2000
Mental Health Act 2007
Mental Capacity Act 2005
Care Quality Commission (CQC) Codes of Practice
The Health and Care Professions Council (HCPC) Codes of Practices
Information is managed in a two main ways within health and social care settings, one of which is physically
filed. A benefit of this format of storing information is that files can only be accessed by those permitted to do
so i.e. they are given the key to the filing cabinet. However, if these files are destroyed service professionals
have no way of restoring the information except asking service users individually which may be perceived as
a waste of time for many because they service users trusted health and social care services to protect their
personal information. Another way information is managed is electronically, this allows professionals to easily
access up to date information whenever they need it, however there are some issues about security and if the
files can be hacked then spread therefore breaching confidentiality.
Especially within multi-disciplinary team, it is important that information is stored effectively so that
professionals have up to date information about the services user’s health issues, abilities and their personal
preferences. Information can be collected through questionnaires, interviews or conversations. By keeping
up-to-date information, it ensures that the quality of health care is improved by reducing medication and
medical errors. Additionally, storing correct information will reduce unnecessary tests, such as blood tests,
which in turn will reduce the amount of time patients spend filling out paperwork and briefing providers on
their medical histories.
