INLEIDINGHet recht is een middel om de samenleving te ordenen en vorm te geven. Zonder orde en
herkenbare omgangsvormen bestaat er chaos.
Recht is een onderdeel van de maatschappij. Recht is een poging van de mens om de
maatschappij te vatten door er orde en voorspelbaarheid in te brengen.
Het recht: het is een systematisch en logisch opgebouwd geheel van overkoepelende
principes en specifieke regels, die een onderlinge samenhang vertonen en elkaar niet
tegenspreken.
Niet alle regels die we naleven zijn rechtsregels we kunnen ook onderworpen worden aan
morele, religieuze & filosofische regels.
Om te spreken van een rechtsregel kunnen we stellen dat deze regels afkomstig zijn van de
overheid. Die overheid is in staat de afdwinging van de regels te garanderen: ze kan je dus
verplichten de regels na te leven.

waaraan opgelegde minstens van overheidswege erkende, sancties kleven, die langs
genormeerde instellingen kunnen worden afgedwongen en waarvan de bedoeling is de
orde in de samenleving te organiseren, handhaven of te herstellen”
Recht:
1. Publiekrecht: regelt de situatie van de overheid en de relaties tussen de overheid en
de burger
Bv: bestuursrecht, belastingrecht, …
2. Privaatrecht: regelt de situatie van de individuele burger en zijn relaties met andere
burgers
Bv: familierecht, goederenrecht
Het onderscheid tussen beide is in de praktijk niet altijd eenvoudig te maken, vaak is op
één juridisch probleem bovendien het publiekrecht en het privaatrecht tegelijkertijd van
toepassing.
