During this case study, The Birmingham Cougars football team changed their logo in
1999 due to a copyright infringement case against them by an artist in Birmingham,
Alabama named Jim Clark. Around 1996, Mr. Clark designed a logo for the team to use.
However, the
team never compensated the artist. However, when the team began their 1996 season, they used
a very similar design to Mr. Clarks for two (2) years without his permission. When the courts
heard the case did rule in Jim Clarks favored in which he was compensated, and the team
could no longer use his design.
Nevertheless, the team changed their logo, but to promote and advertise their brand for
the up-and-coming season, they need to show highlights of their best moments from throughout
the years. It posed a problem for the team because all of their footage was from using the logo
design that Mr. Clark created. Based on the research I have conducted; we will discuss if the
Cougar's Football team was protected by "the fair use act" and when using the logo and
showing the highlight film. Was this copyright infringement by using and displaying Jim
Clark's design once again publicly without his knowledge or consent? Lastly, in the Jim Clark
vs. Cougars football team case, we will discuss the Cougars argument and determine if
Congress has the right or power to regulate copyright infringement within a single state.
