Has a Hate Crime Been Committed?

Scenario:

Luke is a white male with a shaved head and a swastika on the left side of his neck. It's

2:00 a.m. and Luke is at a bar drinking alone, but he makes small talk with a stranger seated next

to him. Luke makes a few comments about his radical beliefs. Luke then sees an African

American male, makes a derogatory comment about him, and says, "He's going to get what he

deserves." Luke immediately stands up, walks up to the African American male, and yells some

incoherent comments. Luke then slices the man across the face with a knife. Luke calmly walks

away.

You're on patrol and dispatched to this call. You arrive within a minute. A citizen witness

points out Luke. As you arrest Luke, he admits to cutting the African American male, but he

denies that he specifically targeted the victim because of his race. Luke requests an attorney and

you honor that request. You transport Luke to jail and return to the police department to complete

your report.

The elements of the hate crimes have been met in the case because it consists of the

Violent Crime Control and Law Enforcement Act of 1994 mandated stiffer penalties for federal

crimes targeting victims on the basis of race, color, religion, national origin, ethnicity, gender,

disability, and sexual orientation. The hate crime that was met was because Luke was judging the

young African American off his ethnicity and race. The other crime Luke committed was he had

cut the African-American male in the face with a knife which is aggravated assault all involve
