established America’s national government and fundamental laws, while guaranteeing certain

seizures. This legal right limit the power of the police to seize and search people, their property,
and their homes. The Fourth Amendment was created to secure that the government did not use
illegal methods and or procedures to get evidence against an individual that is suspected of a
crime. Following is an executive summary regarding the common law background of the
Fourth Amendment.
Background of the Fourth Amendment
The Bill of Rights were enacted in 1789, which included the Fourth Amendment. The
principle of the Fourth Amendment is that people have the “right to be secure in their persons,
houses, papers, and effects, against unreasonable searches and seizures” (ushistory.org, 2021).
The Fourth Amendment is the foundation of criminal law jurisprudence and protects the rights
of people. It is also the responsibility of law enforcement officials to adhere too and enforce the
