Abuse The intentional or negligent infliction of harm, unreasonable restraint, intimidation, or
punishment that leads to physical or emotional suffering or pain for a resident; this also includes sexual
abuse, which encompasses involuntary or non-consensual sexual actions that would qualify as offenses
under Penal Code §21.08 (indecent exposure) or Chapter 22 (assaultive offenses), alongside sexual
harassment, coercion, or assault.
Act Chapter 242 of the Texas Health and Safety Code.
Admission MDS assessment An MDS assessment that establishes a recipient's initial eligibility
based on medical necessity for admission into the Texas Medicaid Nursing Facility Program.
Advanced practice registered nurse An individual who holds a license as an advanced practice
registered nurse from the Texas Board of Nursing.
Agent An adult designated with the authority to make health care decisions through a durable

Dietitian A qualified dietitian is someone who meets one of the following criteria: (A) holds
registration with the Commission on Dietetic Registration of the Academy of Nutrition and Dietetics; or
(B) is licensed or provisionally licensed as a dietitian under Texas Occupations Code, Chapter 701, and
has at least one year of supervisory experience in dietetic services within a healthcare setting.
Direct care by licensed nurses Direct care in accordance with the physician’s overall care plan for
the resident involves: (A) evaluating the resident’s health status; (B) planning the resident's care; (C)
assigning duties to facilitate the resident’s care; (D) implementing nursing interventions; and (E)
reassessing and modifying approaches as necessary.
Direct ownership interest Equity ownership in the capital, stock, or profits of, or a membership
interest in, an applicant or license holder.

, Disclosure interest An ownership interest of five percent or more, either directly or indirectly, in
an applicant or license holder.
Distinct part The segment of a facility certified for participation in the Medicaid Nursing Facility
program.
Drug (also referred to as medication) Any of the following: (A) any substance classified as a drug in
the official US Pharmacopoeia, the official Homeopathic Pharmacopoeia of the US, or the official
National Formulary, including any supplements to these; (B) any substance intended for diagnosing,

this definition.
Exploitation The unlawful or improper actions of a caregiver, family member, or another individual
who maintains an ongoing relationship with a resident, using the resident's resources for financial or
personal gain without obtaining the resident’s informed consent.
Fiduciary agent An individual who holds in trust another's monies.
Goals Long-term: general statements of desired outcomes. Short-term: measurable time-limited,
expected results that provide the means to evaluate the resident's progress toward achieving long-term
goals.
Incident An abnormal event, including accidents or injury to staff or residents, which is
documented in facility reports. An occurrence in which a resident may have been subject to abuse,
neglect, or exploitation must also be reported to HHSC.
