DIVERSAS ESPECIES DE TRADICIÓN
Hay que distinguir cuatro especies de tradición:
1-Tradición de cosas corporales muebles
2- Tradición de los derechos reales sobre cosas corporales inmuebles
3-Tradición del derecho de herencia.
4- Tradición de los derechos personales.
TRADICIÓN DE COSAS CORPORALES MUEBLES
Esta especie de tradición y puede ser real o ficta.
La Tradición real o verdadera es la que se hace física o naturalmente, es decir entregando
la cosa al adquirente o permitiéndole su aprehensión material y manifestando el uno la voluntad
de transferir el dominio; el otro, de adquirirlo.
Tradición Ficta es la que se hace por medio de una ficción que represente la verdad, hay
cuatro casos:
Tradición Simbólica: Que es la que se hace por medio de un símbolo que
representa la cosa que se entrega.
Tradición de larga mano: Cuando se efectúa mostrando la cosa y
poniéndola a disposición del adquiriente
