During the rst week, we will study the outlines and main characteristics of the eld of human
rights and private law. On the basis of Collins’ and Mak’s introductory texts, a number of
questions will be elaborated. These questions will form the basis for the further study of cases
and literature in the coming weeks.
The questions that will be addressed in the course as a whole include:
• Which (types of) human rights may have an impact on private-legal relationships?
• What justi cations may be given for the application of these rights in private law?
• Through which techniques can human rights impact private law?
• How do European human rights a ect (national) private-legal cases?
• Which actors are involved and in which institutional settings do they act?
• To what extent and how does the application of human rights in private law re ect legal-
political choices?
• Which legal-political models may guide our analysis?
• What place do these models and the law give to human dignity, as a fundamental value or
principle underlying human rights and private law?
• Which theoretical view on human rights and private law do you nd most convincing and
why?
