I. Evaluate the importance of the standard default clause. As a contracts officer for
the DOE, suggest two ways in which you could combine the standard default
clause with the FAR’s delay provision for the protection of both parties to the
contract. Provide a rationale for your response.
“The Contractor is responsible for performing or having performed all inspections and tests
necessary to substantiate that the supplies or services furnished under this contract conform to
contract requirements, including any applicable technical requirements for specified
manufacturers’ parts. This clause takes precedence over any Government inspection and testing
required in the contract’s specifications, except for specialized inspections or tests specified to
be performed solely by the Government.” (52.246-1 Contractor Inspection Requirements., n.d.)
This clause essentially states that the contractor is inherently responsible for performing, or
having performed, all applicable inspections and tests relating to the final furnished product.
This clause assumes that the contractor is responsible for ensuring that the widget is ready to
fulfill its contractual obligation so as not to create any unnecessary delays. The most important
aspect of this clause is how it orients the government and the contractor in the event of a
dispute. Ideally, both parties would strive to fulfill their contractual obligations without a hitch,
but in the event of a dispute it’s important for both parties to understand where they stand with
regard to the issue at hand creating the delay of work. It's also important to remember that when
you sign a deal with the government, you’re essentially stating that you are going to abide by
the rules laid out within the contract one hundred percent of the time. Both parties have a vested
interest in doing
business together, however delays can hinder contract performance and ultimately lead
to contract termination.
