Parties
Teresa Harris (Plaintiff)
Vs
Forklift Systems, Inc.( Defendant)
Facts:
“Plaintiff” is a legal term that refers to an individual Harris was repeatedly mocked by the
defendant's president and was exposed to sexual innuendos because of her gender. “You're just a
woman,” the president repeatedly told Harris in front of others. What exactly do you know?
(Kubasek, 2017)” Harris thought the case was out of control, so she filed a class action lawsuit
against the defendant and resigned from her work. The court, on the other hand, found that the
remarks in question did not create an offensive environment because they were not "so severe as
to seriously impair psychological well-being" or cause her to "suffer harm." The ruling was
upheld by the Court of Appeals. (Harris v. Forklift Systems, 2018).
Procedure of the case:
When the plaintiff thought that justice had not been done in the lower court, So plaintiff
decided to go to the greatest court of the country (Supreme Court). (DelPo, 1999). The lower
court did not think the defendant's conduct were serious enough to have a much physically and
mentally impact on the performance and the job of complainer. The decision was in the favor of
defendant and the main reason provided by the court was that the insulting and other statement of
hairs was not enough and this will not make much impact on her job and performance so the case
was ruled in the favor of defendant (Kubasek, 2017).
