Parties:


Plaintiff and defendant are two legal words that are often used. The person who files a

civil lawsuit in a court of law is referred to as a plaintiff. The complainant appeals to the court

about the injuries they have suffered as a result of the defendant's actions and offers sufficient

facts. In other side the defendant has a right to defend himself against this case and clear the

court that he is not guilty in the case. Court proceedings must also prove the defendant's guilt

beyond a reasonable doubt before action can be taken against him.


Facts:


In the case of Microsoft vs U.S, the plaintiff was the United States appears that filed

charges with the court Microsoft Corporation is being sued. Sections 1 and 2 of the 1890

Sherman Antitrust Act were used by the United States to accuse Microsoft Corporation of

violating the Act (Brinkley, 8 Apr. 2017.).


Procedure:


The case was held: Microsoft Corporation was accused of attempting to drive other

businesses out of the market. The decision was in the favor of United State by applying the

doctrine of "damage without legal injury," since the government of United States was suffered

harm without legal injury. As a result, Microsoft was kept responsible for its conduct (America,

April 8, 2017). They were also held responsible for being a monopoly and engaging in

anticompetitive practices.
